1. Update

1.1 In May 2006, the CEO reported the granting of the FEPA licence for this proposed development and the intention of the Menai Strait (East) lay holders to seek a judicial review of the decision. The application for judicial review was entered in early July within the time limit. As agreed in May, the CEO prepared a witness statement on behalf of the Committee (Annex A) which set out the Committee’s remit as grantee of the Menai Strait (East) Several Order and responsibilities as a Sea Fisheries Committee.

1.2 Following the May meeting, The Vice Chairman Wales, Dr Stephen Lockwood convened a meeting of the NAW members. They sent a letter (Annex B) to NAW Minister Carwyn Jones regarding the marina proposal and the granting of the FEPA licence. A holding reply was received from the Minister on 19 June in which he stated that the judicial review application prevented him opening a dialogue at this time.

1.3 An interim judgement (Annex C) was made in respect of the Judicial Review Application by the London Courts on 17 July 2006. This judgement raises a number of queries, transfers the legal action to the Cardiff Court and requires an oral hearing of the evidence. It is expected that a date will be set for this hearing in early October.
