The Standards Committee

Composition and role

The Standards Committee shall comprise three members namely the Chairman and Vice chairs England and Wales of the Joint Committee, and the Chief Executive. The Standards Committee shall normally meet at least annually and also when called by the Chairman or the Chief Executive.

Its role is to ensure that the highest ethical standards are maintained across all areas of the Joint Committee’s services for all appointed Members and Officers.

Meetings are open to the public but they may be excluded where information of an exempt or confidential nature is being discussed

 

Terms of Reference

The functions of the Standards Committee do not extend to the consideration of matters affecting individual members of staff, under the provisions of the Joint Committee’s Grievance, Disciplinary and related Personnel Procedures.

The functions of the Standards Committee shall be as follows:

1. To promote and maintain high standards of conduct by all Members and Officers of the Joint Committee, to ensure that the highest ethical standards are maintained across all areas of the Joint Committee’s services.

2. To advise the Joint Committee on the adoption of Codes of Conduct for Members and Officers as required, to keep such Codes under review to assist Members and Officers to observe the Codes and to monitor the operation of the Codes.

3. To be responsible for advising, training, or arranging to train as required, Members and Officers of the Joint Committee on matters relating to the Codes of Conduct.

4. To support the Chairman and the Chief Executive in discharging their role in respect of standards of conduct and behaviour.

5. To request reports on the operation of the Joint Committee’s policies and procedures relating to the conduct and behaviour of Members.

6. To receive Reports of decisions following investigation by the Personnel Officer or Chief Executive of alleged breaches by a Member in complying with the Joint Committee’s Code of Conduct and to implement decisions.

                7. To consider recommendations arising from investigations relating to:

                    (a) the exercise of the Joint Committee’s functions;

                    (b) the Joint Committee’s Code of Conduct;

                    (c) the Joint Committee’s Standards Committee.

8. To approve procedures for the proper investigation of alleged breaches of the Joint Committee’s Codes of Conduct for Members in accordance with the provisions laid down in the Local Government Act 2000 and Regulations made under Section 66 of that Act.

9. To determine the action to be taken if the Standards Committee, following investigation, finds that a breach of the Codes has occurred.

10. To consider the granting of dispensations, in accordance with the provisions of Regulations (Section 81(5) Local Government Act 2000), to Members in respect of the requirement to withdraw from the meeting chamber where a Member has prejudicial interest.

11. To develop approve, and keep under review 'Whistleblowing' Procedures in accordance with the Public Interest Disclosure Act 1998 and Anti-Fraud Procedures.
